Isha was recently offered an extremely tempting offer by a Marathi Television channel wherein the gorgeous mulgi was supposed to be judging a dance show, but given Isha is already neck deep in work with her commitments down south there was no way that she could have considered the offer, even if the offer was a whooping Rs. 80lacs!!!

“There is only this much that one can do, Isha has two films down south and she is one of the most committed actors ever, she refused to even consider the offer that was made, because her film commitments would not have allowed her to give the kind of hours that the reality show would need, so she promptly excused herself,” quipped our source.

M&E sector pins hope on rollout of GST in April 2016 to resolve its tax concerns

Experts say simplification of tax regime necessary for M&E industry’s growth

MUMBAI, March 26, 2015. The Indian Media & Entertainment (M&E) sector, one of the most highly taxed sectors in the country, is pinning its hopes on the rollout of the Goods & Services Tax (GST) as it would simplify the tax regime by combining a multitude of national, state and local taxes. Yet, there are areas of concern as whether entertainment tax would be subsumed in GST and what the rate of GST would be.

These sentiments were expressed by industry stalwarts on the second day FICCI FRAMES 2015,  in a session on ‘An Enabling Tax Regime for the M&E Sector’.

In his presentation, Mr. Himanshu Parekh, Executive Director, KPMG, highlighted some of the key concerns of the film industry such as service tax loss in respect of theatrical revenues; ambiguities surrounding Rule 9A/9B of whether it extends to non-theatrical rights, is it discretionary or mandatory and does it override other provisions of the IT Act; AOP exposure and entertainment tax.

Speaking about the taxation woes of broadcasting companies, Mr. Parekh said that withholding tax in acquisition of TV programs; placement / carriage fee; agency commission and transponder charges were some of the pressing issues. He added that other issues such as deductibility of cost of content; dual levy of service tax & VAT on content; carry forward of loss on amalgamation and taxation of foreign telecasting companies, were not allowing the industry to flourish as there were a number of ambiguities surrounding these issues.

The withholding tax on discount on sale of STB / RCV; double levy of tax on installation & activation charges and double levy of tax on RCV, were the key concerns of the DTH/cable sector, stated Mr. Parekh

Mr. Narayan Prabhat Ranjan, CFO, Viacom 18, pointed out that the sector was being unnecessarily burdened with additional taxes such as levying of both service tax and VAT on the same product. He added that most of the litigation in the sector was due to complexity and ambiguity in regulations. Hence, the government should look at these policies and regulations at the earliest to enable the M&E industry to sustain itselg.

Mr. Sujit Vaidya, CFO, Disney UTV, stated that the growth of the industry and the tax structure were not in step which has led so many tax litigations for the industry. He added that piracy was another key challenge for the industry besides tax discrepancy. To combat piracy, he urged the government to provide incentives to theatre owners to enable them to penetrate rural and tier 2 & 3 cities by increasing the number of screens, which was far less than the desired number at present in the country.

Mr. G Sambasivan, CFO, Tata Sky Ltd, said that the present tax structure of the M&E sector is a dampener for investors as they are not able to predict favourable return on their investments. He suggested that the government should consider lowering of taxes, which were very high and also look at simplifying the overall tax regime.

Mr. Vineet Garg, Deputy CFO, Hathway Datacom, said that the government should facilitate the industry by easing taxation compliance  and provide tax rebate to the sector. He added that the number of tax litigations have been on the rise owing to complex tax structure which needs to be corrected.

Staying ‘glocally’ relevant in the broadcast space

MUMBAI, 25 March 2015: How to stay “glocally” relevant was the theme at a panel discussion titled ‘Retooling Content to Stay “Glocally” Relevant’ at the FICCI FRAMES 2015 convention today. The discussion, moderated by Ms Vanita Kohli Khandekar, media analyst, author and columnist, had as its participants Ms Myleeta Aga, SVP and GM India and Content Head Asia, BBC Worldwide; Mr Gaurav Banerjee, GM, Star Plus & Life OK; Mr Sameer Nair, Group CEO, Balaji Telefilms;Mr Pradeep Hejmadi, Business Head, Zee TV; Mr Tarun Katial, CEO, Reliance Broadcast; and Mr Vijay Subramanium, Vice President and Head, Content & Communication, Media Channels, Disney India.

Ms Kohli opened the discussion by observing that at least seven to 10 large broadcasters control the major share of the broadcast space. The market is growing, and audiences are watching varied programmes. “How is the audience coping?” she asked the panellists as she sought their views.

Mr Subramanium felt that the present times are exciting from the consumer’s standpoint. From the service provider’s view, it is interesting to see how those needs can be met. His company feels that technology is a friend, and he cited the case of the recent new Mickey Mouse shots for their global initiative. In India, instead of holding a grand premiere, they put up the content on Facebook; that doubled their channel and slot ratings. “We at Disney are innovating to serve consumers,” he concluded.

Ms Aga informed the house that BBC Worldwide has been looking at different marketing and technical strategies based on what the content is and what the market requires. Every country has a different market strategy. “Not one formula fits all,” was her take. Mr Katial agreed that the consumer is at the centre. “Until you have great consumer insight you won’t get anywhere.” But he felt that the industry is not doing enough. “We’ve got to stop, and start;” he said, noting that the smaller players can afford to look at things differently. That is how his channel operates.

Mr Banerjee was of the opinion that today, content providers have more ambition. About five years ago, stories were confined to household and kitchen politics. Today, that is changing. Another change is that broadcasters are willing to spend more money. “I don’t think enough research was being done in the past, but that is beginning to happen.” But what hasn’t changed is the importance of storytelling. Television in India has a reach that is greater than that of any big film with a major cast. “That is a great responsibility. It is the pressure to continue to create shows that inspires.” He strongly felt that research will allow content to get better. He called upon the industry to shed its fear of failure. Mr Nair agreed that TV content in India is not good enough; this could be because content changes slowly. Producers are not willing to trash existing content because it has grown in the market. “When the market reaches a critical mass, not everyone wants to see the same thing and economics dictates everything.”

Mr Hejmadi felt that broadcasters may or may not be ready to part with IP. They anyway have to put in a lot of intellectual input to create content. “Hence they don’t see the need to part with IP.” Ms Aga agreed, saying that producers do not want to invest in developing the idea. “We are habituated to going to broadcasters without enough content,” she said. Mr Nair also felt that IP is over-rated and there is no point in getting over excited. “It is about risk and reward, there is no big upside.” Mr Katial disclosed that they see themselves as “hiring out a line producer to execute on our set.” All panellists agreed that producers and broadcasters should experiment more and take more risks.

Mumbai, March 25 2015: Filmmaker Kiran Rao will spearhead a new and unique film centre in Mumbai“FilmBay”, a National Film Development Corporation (NFDC) initiative to be launched by the end of this year. The “FilmBay” will provide an alternative, exhibition space for independent and art-house cinema and documentaries that may never get a traditional commercial Bollywood release.

Kiran Rao, as Creative Director, will be supported by renowned members of the industry, Anupama Chopra, Anurag Kashyap, Zoya Akhtar, Dibakar Banerjee and Rohan Sippy, who will bring in their collective expertise to make the Film Centre a diverse, eclectic hub for debate and discussion.

A collaboration between NFDC and Municipal Corporation of Greater Mumbai, the FilmBay will be based at an existing theatre at Sherly Rajan Village, Bandra (W), whichwill be completely revamped by NFDC and will be equipped with an exhibition hall, a 100-seater digital cinema, a reading and research library, a bookshop and a cafeteria.

The FilmBay has been given on lease to NFDC by the MCGM for a period of 30 (thirty) years from January 2, 2015, to exhibit films along with educational and promotional activities for the growth of cinema. Further, the Centre will also emerge as a hub for the film fraternity and cinephiles to interact and share film wisdom. The Centre will also aim to hold special screenings for the children of municipal schools to enlighten and enhance their vision for good cinema.

In addition to the members of the film fraternity, the board will also constitute two representatives of NFDC and one from MCGM.

Serving the three-year term, the Advisory Committee will be involved in numerous activities such as-

  1. Assisting in developing goals and plans.
  2. Recommending programmes and suggesting addition, deletion or revision of programmes when needed, to meet the said theatre’s needs.
  3. Suggesting time frames and priorities for the implementation of approved plans and programmes.
  4. Monitoring and conducting evaluations of the programmes and recommending procedure for change as a result of the evaluation.
  5. Investigating the need for new programmes for the said theatre.

Objectives of NFDC’s FilmBay:

  1. To make the venue the preferred destinations for viewing films and related performing arts and establish the clear synergy and connection between the same.
  2. To organize special viewing of Children’s Films.
  3. To promote cultural and art films, by providing and managing a well-equipped theatre space at very reasonable costs, with all technical facilities.
  4. To subsidize and promote aspiring and deserving film directors, artists, technicians, researchers etc.
  5. To host and conduct workshops for adults and children.
  6. To create a film resource Centre and research library.

The Creative Director of the proposed centre, filmmaker Kiran Rao says, “It has long been my dream to have a space for cinema as art, where one can experience and engage in different ways with a diverse and challenging array of films, and Filmbay is that dream coming true! Thanks to the BMC, we found the ideal space to build a centre for the appreciation of cinema on an institutional scale, and under NFDC, the centre is finally taking shape. Mumbai, with its 100 year history of film, deserves a space for the encouragement and celebration of cinema, and through an eclectic film program as well as a library and archive, we hope to further the conversation around cinema both for the film professional and the film enthusiast.”

Nina Lath Gupta, Managing Director, NFDC India, says“The Filmbay in Mumbai is a natural corollary to NFDC’s endeavour to facilitate the growth of the good cinema movement in India. This multi-faceted initiative, a brainchild of Kiran Rao, supports NFDC’s intent of pursuing innovative methods of exhibiting and making accessible diverse filmic content to a larger audience base, thus promoting India’s vibrant cinematic movement.”

Shri Sitaram Kunte, Municipal Commissioner, Municipal Corporation of Greater Mumbai says, “We are very happy to collaborate with NFDC on this wonderful initiative. Mumbai being the film capital of India, needed a unique platform where young filmmakers and cine enthusiasts can come together to share and experience the cinematic movement of both India and the world. With the creative fraternity of the film sector throwing their weight behind this venture, I am sure the venue will become an iconic landmark of Mumbai in a very short time. “

Zoya Akhtar, the director of Zindagi Na Milegi Dobara, says, “This city gets access to independent world and regional cinema on a big screen. The filmmakers get a platform to exhibit their work the way it should be shown. And film lovers get a space where film can be art and not just commerce.”

Film critic Anupama Chopra says,
“FilmBay will be an excellent venue providing audiences an opportunity to discover and celebrate Independent films. It will be a great platform for cinephiles to come together to exchange idea and watch the best of world and regional cinema and expand their cinematic vision.”

The filmmaker Rohan Sippy says, “We are home to a large film industry which does not only make commercial films but independent films too. Multiplexes are commercial entities but it’s important to have a venue where you can showcase and watch alternative and independent cinema. It will provide young filmmakers a fantastic platform to exhibit their films and interact with the audience directly. And If a film is liked here then it opens many more venues for the film to be screened worldwide.”

FICCI-KPMG report

Speedy execution of policies; approvals for multiplexes, live events & film shoots will

pave way for India to be global entertainment superpower: FICCI-KPMG report

MUMBAI, March 25, 2015. India could well become a global entertainment superpower, provided key enablers such as flawless and timely execution of policies and  interventions at a local level like speeding up permissions for multiplexes, live events and film shoots are put in place by the government. For the Indian media and entertainment players it is imperative to have tailored content strategies for global, national and local audiences and a focus on building the relevant digital and physical touch points to enable easier and more open and interactive access, says the FICCI-KPMG  Indian Media and Entertainment Industry Report 2015, titled ‘Shooting for the Stars’. The report was released here today at the inaugural session of FICCI FRAMES 2015.

The report notes that India’s significant consumer market base, and increasingly favourable macro-economic and regulatory environment have prompted several investors and global players to look to the Indian market for growth.

Their optimism stems from the fact that the building blocks for future growth have been put in place in 2014 – such as new spectrum for mobile, ongoing digitization in cable, consolidation in exhibition, and Phase III auctions for radio. With the advertising boost from the ICC cricket world cup, strong projections for economic growth and on the base of these building blocks, 2015 holds great promise for the industry.

2014 has been a turning point for the Media and Industry sector in India in many ways. Post general elections, with a stable government at the centre, business sentiment has been positive and bolstered by a number of growth promoting policy initiatives taken in the recent months. A benign external environment and the presence of a stable government prompted the Economic Survey to suggest that India has reached a sweet spot and could finally be launched on a double-digit medium-term growth trajectory. Top global institutes also have an upbeat view on India. Rating agency S&P called India the Asia-Pacific region’s bright spot while the International Monetary Fund revised up India’s growth forecast, expecting its growth rate to surpass China’s in 2016.

The FICCI-KPMG report points out that in the media sector, digital media continued its rapid penetration, as indicated by the stupendous 44.5 per cent growth in digital advertising in 2014 over 2013. One of the major highlights in 2014 was the announcement of ‘Digital India – A programme to transform India into digital’ by the new Government at the Centre. India topped as the world’s fastest growing smartphone market. By the end of 2014, India had around 116 million internet enabled smartphones and the number is expected to reach 435 million by the year 2019. This growth presents a good opportunity for digital content aggregators, advertisers, app developers and online streaming companies to engage users through relevant mobile-led strategies.

The absolute number of internet connections was at a record high in 2014. With almost 9 per cent penetration of social media, India’s potential for social networking on the internet is on the rise. 41 per cent of India’s total mobile users are active on social media. The digital music industry witnessed a good deal of buyouts, sell-outs and new entries jockeying for position. The revenue from distribution of music through digital channels already accounts for over 50 per cent of the overall size of the music industry in India.

In television, advertising saw strong growth, driven by the general uplift in the macroeconomic environment, the general election spends, and the emergence of e-commerce as a significant new advertising spender. At the same time, despite rollout of digital set top boxes STBs as a part of the ongoing DAS, the anticipated improvement in addressability, increase in subscription revenues and more equitable sharing of subscription revenues continues to evade the industry. A key challenge remains the lags in implementation. The MSOs are taking time to build internal processes to reflect the change in business model from B2B to B2C. This, coupled with continuing resistance from LCOs, has resulted in delays in implementation of gross billing and rollout of channel packages in Phase I & II cities. The Ministry of Information and Broadcasting  has now extended the deadlines for Phases III & IV of DAS implementation to 31 December 2015 and 31 December 2016, respectively.

The print sector continues to remain a highly fragmented space, at the national and regional level. In 2014, the print industry witnessed a rise in circulation revenues on the back of rising cover prices and subscriptions, aided by low media penetration, population growth and rising income and literacy levels. This growth largely came from tier II and tier III cities with regional language editions outperforming the national editions and English dailies. While the sector has not seen cannibalization in revenues from digital media, on the lines of the global trend, it is clear that the time has come for players to embrace digital strategies that complement the existing physical product and support brand building and penetration efforts.

The films sector was a mixed bag in 2014 with some films creating box office records, while several were unable to attract audiences to the theatre and profitability was impacted overall. The exhibition sector saw several players expanding their footprint – both organically (especially in tier II and tier III cities) and through acquisitions. The cable and satellite market also saw correction. Regional films continued to see success, in particular the Tamil and Telugu markets. Going forward, with an increasing number of multiplex screens and better internet penetration and bandwidth Tier 2 and Tier 3 cities may soon hold the prime focus of the industry.

The radio sector saw much awaited movement in Phase III auctions, with the Government giving the go ahead for partial auctions across 69 cities, potentially 135 channels. Though some key contentious issues of exorbitant reserve prices for the auctions, the 15% limit on the total number of frequencies that an entity may hold, as well as dearth of new frequencies in the profitable A and A+ cities remain, the commencement on Phase III provided the required fillip to the industry which hopes to revive its fortune with these new developments.

Ek Paheli Leela Shot in the Iconic locations of Rajasthan!!

Sunny Leone in Ek Paheli Leela

Rajasthan is known for its heritage sites and old world charm. The state and its various locations make an important character in Sunny Leone’s next Ek Paheli Leela.

Sunny who is already drooling her fans with her desi look in the film has an added charm to the scene – the picturesque locations of Rajasthan. To bring more authenticity to the character and the story, Director Bobby Khan chose to shoot at real locations and heritage sites like the famous Khimsar Fort, the sand dunes and many other. The team shot at night with the heritage fort’s beautifully lit décor and ambiance adding a majestic glow to the scenes. This made the on lookers think it was a grand wedding function in real. The luxurious Laxmi Nivas Palace, the former residential palace of the king of the former Bikaner state, Mahārāja Ganga Singh, in Bikaner was also utilized for some of the scenes!!

But to accommodate some major sequences of the film, the team had a recreate an old style village on a desert land in just 15 days which also included the real Rajathani villagers to be part of the shoot. The entire location was so big that SUVs were arranged to take the artists and crew from point A to point B. Bobby Khan says, “The theme of my film starts from London and movies to Rajasthan therefore we went ahead and shot in some beautiful locations of Rajasthan. This is the first time that Sunny has shot in the scorching heat of 47 degrees in Rajasthan and she did a marvelous job and the shoot went of smoothly… Visually the audiences would get a treat by seeing some really nice locations of Rajasthan”

The film is beautifully shot and the sunrise color schemes give it a surreal and dream like quality… What’s interesting is that Leela has also been shot in the iconic Panchkuda Ki Chatriya- where the Satyam Shivam Sundaram look was shot!!! Well with such breathtaking locations on display in the film, we are sure the film will be one visually stunning masterpiece!

Produced by T-Series and Paperdoll Entertainment and directed by Bobby Khan, Ek-Paheli Leela is all set to release on 10th April 2015.
